C-15 an Act to amend the Controlled Drugs and Substances Act

This enactment amends the Controlled Drugs and Substances Act to provide for minimum penalties for serious drug offences, to increase the maximum penalty for cannabis (marihuana) production, to reschedule certain substances from Schedule III to that Act to Schedule I, and to make consequential amendments to other Acts. C-15 is the reincarnation of Bill C-26 from the 39th Parliament with minor changes that clean up the language of the bill.

WHAT’S WRONG WITH MANDATORY MINIMUM SENTENCES?

  • aggravating factors under Bill C-15 are vague, including the term “any other public place usually frequented by persons under the age of 18 years.” This could be anywhere, and you won’t know until it’s too late!
  • In 2006, 4737 Canadians between 12 and 17 were charged with a cannabis offence. Because of Bill C-15 this number will rise, and the aggravating factors developed TO HELP YOUTH will be SENDING MORE YOUTH TO JAIL!
  • A 2002 Justice Department of Canada report concluded that mandatory minimum sentences (MMS) are least effective in relation to drug offences. Read a copy of the report here (pdf).
  • Mandatory Minimum Sentences are “tough on the wrong people”. The supposed targets for these sentences - the Kingpins – are in the best position to negotiate lighter or no sentence deals with the prosecutors. Instead youth and their families will bear the brunt of harsher penalties, longer trials, and expensive fees.
  • Mandatory-sentencing policies have produced record incarceration rates of non-violent drug users in the United States.
  • The US Sentencing Commission also concluded that MMS fail to deter crime and reported that that only 11% of federal drug defendants are high-level drug dealers, 59% of crack defendants are street level dealers compared to 5% of defendants who are high level crack dealers.

Instead of pretending a stricter prohibition will work, why aren’t our politicians WORKING TO END PROHIBITION?

Canadian Students for Sensible Drug Policy, along with countless other groups across Canada, will be actively opposing Bill C-15 and we need your help. Parliament is moving fast to rush this Bill through before the public finds out about the lies that Bill C-15 will make us safer, cause it won’t.

CONTACT JUSTICE MINISTER ROB NICHOLSON DIRECTLY. He introduced Bill C15 and has to be told that Canadians don't stand behind him. Be clear and polite, telling him you do not support his plan and that studies show mandatory minimums do not work.

TAKE IT TO YOUR HOME TOWN. Tell your friends, family, whoever what Bill C-15 is and why it is a terrible idea. Write letters to your local newspaper, to the larger newspapers, to the blogs, wherever. Get the word out there that Parliament is trying to rush through a half-baked drug policy that will continue strategies that are failing all Canadians.
